Cyberlytics Terms & Conditions
Last Updated: July 23, 2026
Introduction
These Cyberlytics Terms and Conditions govern your use of cyberlytics.dev, related forms and booking tools, and the professional digital services we deliver. By browsing this site, submitting an inquiry, paying a deposit, or signing a project agreement, you agree to these terms.
Cyberlytics is a Houston digital partner focused on high-conversion websites (primarily Drupal), AI-assisted marketing, SEO, performance and security, and marketing automation for growing businesses in Houston, Pasadena, Conroe, The Woodlands, Katy, Sugar Land, Pearland, League City, and Galveston, as well as clients across Texas and the United States.
Terms for Digital Services
Cyberlytics provides professional services including Drupal and high-conversion web development, website security, speed, and performance management, AI-assisted SEO and analytics, AI-integrated social media automation, email and CRM campaign automation, and B2B digital marketing programs.
All services are subject to availability and a written or emailed scope of work. Deliverables, timelines, and acceptance criteria are defined in your proposal, invoice package, or project agreement. Outcomes such as search rankings, ad performance, or lead volume depend on many factors outside our sole control (markets, competition, platform rules, client follow-through) and are not guaranteed unless expressly stated in writing.
Agreement & Onboarding
Engagements are confirmed when you accept a proposal (email is sufficient) or execute a project agreement, and—where required—pay the deposit or first invoice. Cyberlytics will provide an estimated timeline and a kickoff checklist.
You must grant timely access to domains, hosting, CMS admin, analytics, ad accounts, CRM, DNS, third-party plugins, brand assets, and content needed to perform the work. Delays in access, approvals, or content may extend delivery dates without liability to Cyberlytics.
Cancellation & Rescheduling
Please cancel or reschedule strategy calls, workshops, or implementation windows in writing (email is fine) as early as possible. Once discovery, design, development, or campaign setup has begun, deposits are generally non-refundable and time already spent is billable.
If you need to pause a project, we will document remaining work and resume dates when possible. Long pauses may require a restart fee or a revised estimate if tools, platforms, or scope have changed.
Scope & Pre-Project Review
Before major work begins, we align on goals, target audiences, service areas (for multi-city Houston programs), technical constraints, brand guidelines, and out-of-scope items. Change requests outside the agreed scope may require a change order and additional fees or schedule adjustments.
Raise known issues early—legacy migrations, incomplete content, third-party integrations, compliance needs, or security incidents—so we can plan accurately.
Project Conditions
Delivery can be affected by delayed approvals, missing content, DNS or hosting limits, third-party API outages, plugin conflicts, or platform policy changes (search engines, social networks, email providers, payment gateways). Cyberlytics may adjust timelines to protect quality and will notify you of material changes.
Staging and production deployments should follow an agreed review process. “Go-live” is not the same as perpetual support unless you purchase an ongoing care, security, or marketing retainer.
Customer Responsibilities
You agree to provide accurate business and contact information; appoint a decision-maker; review drafts, designs, and releases within agreed timeframes; secure licenses for client-owned media and software; and comply with applicable advertising, privacy, and industry rules for your business.
You are responsible for maintaining strong passwords, MFA where available, and lawful use of marketing lists. Cyberlytics is not liable for delays or defects caused by incomplete access, inaccurate briefs, or client-side changes made without coordination.
Client Preparation Checklist
- Share business goals, priority cities/service areas, and success metrics
- Grant admin access to website, hosting, DNS, analytics, ads, CRM, and email tools as needed
- Provide brand assets, copy, product/service lists, and legal disclaimers unique to your industry
- Designate a single point of contact for approvals and feedback
- Review and approve milestones within the agreed window so the schedule stays on track
- Disclose known technical debt, prior agencies, or compliance constraints up front
Pricing, Payments & Deposits
Prices are quoted in USD and may change for new work not already under agreement. Package pricing on the website is illustrative; final fees depend on scope. Payment schedules (deposit, progress, launch, retainer) are stated on your invoice or proposal.
Deposits reserve team capacity and fund discovery and setup. Late payments may pause work. You are responsible for applicable taxes and for payment method fees when they apply.
Refunds & Satisfaction
Digital services are custom and time-intensive. Completed or substantially completed work is generally non-refundable. If you believe a deliverable does not meet the written scope, notify us in writing within 48 hours of delivery with specific examples.
We will review project records and may offer revisions within scope, a partial credit, or another remedy at our discretion. See also our Bookings & Refunds Policy for deposit, no-show, and rescheduling rules.
Satisfaction Resolution Process
1) Email [email protected] with project name, URLs, screenshots, and the gap versus agreed scope.
2) We investigate and propose a fix plan.
3) In-scope revisions are completed on a reasonable schedule.
4) Out-of-scope items are estimated as a change order.
We aim to resolve issues fairly and promptly while protecting both product quality and team time.
Liability
To the fullest extent permitted by law, Cyberlytics is not liable for indirect, incidental, special, consequential, or lost-profit damages, including lost rankings, ad spend waste, or business interruption caused by third-party platforms or client systems.
Our aggregate liability for any claim related to a service is limited to the fees you paid Cyberlytics for that specific service during the three (3) months preceding the claim. Nothing in these terms limits liability that cannot be limited under applicable law.
Ownership & Website Use
Upon full payment, you receive a license to use the custom deliverables created for your project (for example site templates, configured modules, campaign assets, and documentation) for your business. Cyberlytics retains ownership of pre-existing tools, frameworks, generic components, know-how, and reusable patterns, and may use them in other projects unless a written work-for-hire or assignment agreement states otherwise.
Third-party software, fonts, stock media, plugins, and SaaS subscriptions remain subject to their own licenses; you are responsible for ongoing license fees after handoff unless included in a retainer. Marketing site content on cyberlytics.dev remains Cyberlytics property. Do not scrape, republish, or misuse our site in violation of our robots.txt and content signals.
Acceptable Use of Our Website
You may not attack, scrape at abusive scale, attempt unauthorized access to private subdomains or admin areas, upload malware, or use the site for unlawful advertising. We may suspend accounts or refuse service for abuse, nonpayment, or illegal activity. Public marketing pages are separate from private applications (finance, HCM, booking admin, webmail) which are not offered as public content.
Changes to Terms
We may update these Terms & Conditions. The “Last Updated” date will change when we do. Material updates will be posted on this page. Continued use of the website or services after an update constitutes acceptance of the revised terms for future work; active projects remain governed by the agreement in place when they were confirmed unless both parties agree otherwise.
Related Policies
Please also review our Bookings & Refunds Policy and Privacy Policy. For security reports, see security.txt and email [email protected].
Frequently Asked Questions
When is payment due?
Payment is due according to the schedule on your proposal or invoice (often a deposit to start, then progress or launch payments, or monthly retainers). Other arrangements must be approved by Cyberlytics in writing before work begins.
Who owns the website or code I pay for?
After full payment, you receive a license to use custom deliverables for your business. We keep rights to generic frameworks and reusable components unless a written assignment says otherwise. Third-party licenses stay with their vendors.
How do I report a service issue?
Email [email protected] within 48 hours of delivery with project details, URLs, and specifics. We will review against the agreed scope and propose a resolution path.
Can I cancel a project after it has started?
Yes, with written notice. You remain responsible for work completed, non-recoverable third-party costs, and deposits already applied once preparation or delivery has begun. See the Bookings & Refunds Policy for deposit details.
Are deposits refundable?
Deposit rules vary by package. Once discovery, design, development, or campaign setup has started, deposits are generally non-refundable. Unused deposits for cancelled work may sometimes be applied to future Cyberlytics services at our discretion.
